You voluntarily assume full responsibility for any and all risks of injury or death associated with the use of services offered by Functionally Fit, Ltd., including but not limited to strength training, conditioning, nutritional guidance, and other fitness, wellness, or lifestyle activities.
3.0 Release and Waiver
3.1 You hereby forever release and discharge Functionally Fit, Ltd. from any and all liabilities, claims, demands, or causes of action that you may hereafter have for damages or injuries arising out of your participation in any activities or use of any services recommended or provided by Functionally Fit, Ltd., but not including any gross or wanton conduct.
3.2 You cannot sue or assert any claim against Functionally Fit, Ltd. for any loss, injury, damages, or liability arising out of or related to Functionally Fit, Ltd.’s services. This release of liability includes but is not limited to claims alleging negligence by Functionally Fit, Ltd.
5.0 Severability
5.1 If any provision of this disclaimer is deemed invalid or unenforceable, that provision will be modified to the extent possible to make it valid and enforceable. 7.1 All documents included or exchanged between Functionally Fit, Ltd. and the Client or Viewer are the intellectual property of Functionally Fit, Ltd. and are not to be copied, sold, or redistributed without an authorized Functionally Fit, Ltd. agent’s express written and signed consent.
